How Pandemic-Related Court Closures Have Affected Divorce Proceedings
Due to the COVID-19 Pandemic, only essential case types and hearings are being conducted in-person at Clark County Courts. On March 16, 2020, the Chief Judge of the Eighth Judicial District Court issued an administrative order requiring that all non-essential District Court hearings are to be conducted by alternative means such as telephonic or video appearances. Therefore, most family law matters are being conducted remotely.
At the Miley Law Firm, we provide aggressive, professional representation for those seeking a divorce or legal separation in Nevada. Despite the pandemic, family law proceedings continue to be heard. Our office can provide effective counsel during this trying time and will guide you through the process of filing for divorce in the state. Request a consultation today at 702-942-0600.
Remote Divorce Hearings
With the Nevada courts nearly shuttered, most hearings are being conducted remotely via telephone or video conference. In some cases, matters may also be decided on the papers or rescheduled. Family law matters such as petitions for divorce or legal separation are no exception. The administrative orders requiring these measures were put in place to stop the spread of the Coronavirus and remain in effect until further notice.
It is important to note that you must still follow specific codes of conduct despite your hearing being heard remotely. If you are required to appear remotely:
- Dress as though you were appearing in-person. You should wear professional attire at all court hearings.
- Find a quiet, well-lit setting to connect to the hearing.
- Wear headphones, if possible.
- Test your audio and video settings prior to connecting.
- Make sure that what is visible in your camera background is appropriate. Adjust the camera view so that it is eye-level.
- Be on time.
Filing for Divorce in Nevada
Despite restrictions being placed on in-person hearings, the basic process for divorce remains the same in Nevada. To be eligible, you or your spouse must have resided in the state for a minimum of six weeks. It is always recommended that you consult with an attorney before filing for divorce so that you understand your rights and your responsibilities. If you and your spouse cannot agree on the terms of the divorce, then you will need to begin the process by filing a complaint for divorce.
Our attorneys will help guide you through the divorce process. We will prepare the appropriate paperwork, file it with the courts, and assist you with your remote or in-person hearing.
A divorce proceeding can finalize several things that may be in dispute, including:
- Property division
- Debt allocation
- Child custody or visitation
- Child support
- Alimony or spousal support
